Terms and Conditions

ARTIST

“Art by Kagsy” , "Kagsy" and “KL” is the artist’s title for Karen Laing.

 

PURCHASER

The individual purchasing the work.

 

REPRODUCTION OF ART

No work produced by the artist may be displayed without notifying the artist first. Any sites known to display, reproduce, and/or sell works must credit the artist after gaining permission.

 

AUTHENTICY AND PURCHASE

With every piece of work, including prints, there will be a certificate of authenticity (signed and dated by the artist) provided as proof of authenticity and purchase. For limited editions pieces, it will clearly state the purchased number in the series. Once the set number of pieces has been exhausted, no more will be made and any requests to do so will be refused.

 

SALE OF ARTWORK

Full payments must be made when purchasing any item or artwork from this site. Should an offer to pay in instalments be granted or offered, delivery will only conclude on the receipt of payment in full. Payment method is determined as written in the agreement of purchase (PayPal only).

 

NOTE: All prices are stated in UK Sterling (£). It is the purchaser's responsibility to ensure that they have converted currencies based on current exchange rates.

 

PURCHASER AND RE-TRANSER

The purchaser will be deemed the person whose details are attached to the original sale. If the purchaser sells, gives, or trades any original artwork purchased from this site or the artist known as Kagsy, they must notify the artist (or the representative of his/her estate) within thirty (31) days maximum.

 

TRANSFEREES

If anyone becomes the new owner of the work, then that person shall be bound to all its terms and conditions, as outlined in this document.

 

AGREEMENT OF PURCHASE

A documented discussion (via email) in which the artist and purchaser agree to the sale of the work, the sale price, sale address, transfer of copyright or any other additional details such as framing, mounting, or shipping costs. This agreement of purchase shall remain on record with the artist, along with any other documents related to the work as proof of production.

 

COPYRIGHT AND REPRODUCTION

The artist retains full copyright and reproduction rights of the work purchased unless otherwise stated and agreed upon in an agreement of purchase. The artist also retains full copyright for any preliminary designs, sketches and unintentional works made in the creation of the artwork. The artwork may not be reproduced, sold, or used for any profitable purpose without the expressed written permission by the artist.

 

Unless agreed through an agreement of purchase, the artist has the right to any images of the purchased work for their portfolio, website, and any social media platforms the inhabit. The purchaser does not have the right to sell copies of the work in any way without permission from the artist.

 

NOTICE OF EXHIBITION OR SHOWS

Before committing any work to a show or exhibit, the purchaser must give the artist notice of intention with full details which includes date(s) and location.COMPETITIONSUnder no circumstances may the purchaser submit the purchased work to any competitions, online or off. CHANGES TO PURCHASED WORKThe purchaser is not permitted to make any intentional destruction, damage, or modifications to the purchased work. To do so will void the certificate of authenticity and reduce its value.

 

RESTORATION

If the purchased work is damaged (not including in delivery transit from artist to purchaser) the purchaser will agree to consult the artist before any restoration is performed. The solution will be agreed by artist, performed, and put in writing to keep the work’s authenticity intact.

 

DELIVERY / PRODUCTION TIMES.

Delivery timescales will be clearly stated by the artist in each listing. However, there may be times when these times cannot be adhered to and may take slightly longer than advertised. Each item (other than prints) is handmade or made to order. The artist is by no way responsible for delivery delays or timescales.

 

The work will be posted via special delivery (insured) from the UK. The purchaser will be given a tracking number as proof of postage. The work will be shipped in protective packaging. Overseas delivery charges will be agreed before a purchase is made, unless stated on the listing.

All work over £50 (sterling) will be insurance with the courier in the event of loss or damage and reflected in the postage cost.

 

ADDRESS NOTICE

The purchaser is responsible for ensuring their contact details are true and correct. Incorrect in formation may result in extra delivery charges.

 

DAMAGES, THEFT AND MISPLACEMENT

The artist is not responsible for any damages made to the work except for those inflicted at the fault of the artist or during the artist’s possession. Should this occur, the artist will contact the purchaser immediately if need be. The artist is not responsible for any theft or misplacement of the work once it has left the artist’s possession. The purchaser accepts all possible risks once payment is made.

 

If damages occur while in transit, the purchaser must notify the artist within two (2) days of receipt of work and must provide evidence of damages for a valid claim to be made. If the work has been damaged but the purchaser still wants to retain ownership, the artist will negotiate a reduction in price where possible.

 

If the work is stolen, lost, or perished during transit, the artist will make a full claim on the courier’s insurance. Reimbursement will only occur once the claim is settled with the carrier.

Any damages or misplacement caused at the fault of the purchaser or during the purchaser’s possession no refund is entitled

 

RETURNS

Returns are not accepted unless the product has been damaged prior to the purchaser receiving it. The cost of postage for any returned damaged work is the responsibility of

the purchaser.

 

DATA PROTECTION

The artist will need to collect the following information: the purchaser’s name, postal and email address. This information will only be used to send invoices and delivery of work. The purchaser’s name will be stored to keep track of orders. Once the purchaser has received the work, records of all addresses will be deleted.

 

COMMISSIONS

I am currently unable to take on any commissions, though this is subject to change it will be announced in an appropriate manner.

 

EXPIRATION

The sale of all purchased work binds all parties, their heirs and all their successors to the original purchaser’s obligations, all for the life of the artist and artist’s surviving spouse plus 30 years (30) years, unless otherwise stated.

 

MORAL RIGHTS

The purchaser will not permit any use of the artist’s name or misuse of the work which would serve any discredit on her reputation as an artist, or which would violate the spirit of the work. In no way will the purchased work be used in anything that is deemed, hateful or racist imagery, illegal activities, or sites known to display, reproduce, and/or sell works without crediting the artist.

 

PROMOTION

The artist may use any images of the work for promotional purposes. The artist may also sell limited edition prints, sculpture art, paintings or anything theme related. Merchandise for the work may be available at the artist’s discretion, unless negotiated with the purchaser.

 

EXPENSES

If work is commission at any point, the artist and purchaser will negotiate on which party will pay costs and expenses, including insurance, for the crating, packing and shipping of the work.

 

ARTISTIC DAMAGES

The artist has the right to pursue damages under British Copyright Law, should there exist a violation in addition to a breach of these terms and conditions or copyright infringement.
